Terms of sale
These terms apply to everything you buy from Benaiah Shop, operated by Benaiah Godson Pty Ltd (ACN 700 861 758). By placing an order you accept them.
1. Prices
Prices are in Australian dollars. The price you see at checkout is the complete price for the configuration you chose, including delivery and any location loading. We do not add charges after checkout.
Prices for made-to-order, sourced and installed work depend on the options you select and your location, and are calculated before you pay. We may change published prices at any time, but never after your order is confirmed.
2. Orders
Your order is an offer to buy. A contract forms when we confirm the order. We may decline an order — for example where an item is unavailable, where a price was listed in error, where we cannot verify your details, or where a legal or safety requirement is not met. If we decline after you have paid, we refund you in full.
Some items are arranged by application rather than sold directly. For those, nothing is committed and no payment is taken until the scope and the complete price are confirmed with you.
3. Items sold by other merchants
Some listings are referred. Those items are sold by another merchant, whose name is shown on the listing, and you complete the purchase and pay on their site — not ours. We introduce the sale and may earn a commission for it.
For a referred item your contract is with that merchant. They are responsible for the price, stock, delivery, warranty and returns, and your consumer guarantees under the Australian Consumer Law run against them rather than against us. We do not take your payment, do not handle GST on the goods, and do not issue an invoice for them. Read the merchant’s own terms before you pay.
Where a listing is not marked as sold by another merchant, we are the seller and the rest of these terms apply in full.
4. Payment
Ready and made-to-order goods are paid in full at checkout. Larger installed and built work may be payable by deposit or by milestones; where that applies, the schedule is shown before you pay. Title in goods passes on full payment. Risk passes on delivery.
5. Age-restricted and regulated items
Some goods carry legal restrictions — including age verification on delivery, state-based limits, and licensing or compliance requirements for installed work. Where a restriction applies it is shown before checkout, and you must meet it. Orders that fail a compliance check are refunded in full.
6. Delivery and consumer rights
Delivery terms are set out in our delivery policy. Your rights when something is wrong are set out in our returns policy. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law.
7. Our liability
To the extent permitted by law, and other than the rights you have under the Australian Consumer Law, our liability for any claim connected with an order is limited to re-supplying the goods or services, or paying the cost of re-supply. We are not liable for loss that was not reasonably foreseeable.
8. Accounts
You are responsible for keeping your account password confidential and for activity under your account. Tell us promptly at care@benaiah.app if you believe it has been used without your authority.
9. Governing law
These terms are governed by the laws of New South Wales, Australia, and you and we submit to the courts of that jurisdiction.
